قدرت تيزبينى کنگره

فرهنگ هاى لغت کلمه “تيزبيني” را بعنوان نظارت دقيق تعريف مى کنند و ثابت شده که اين طرز برخورد يکى از موثرترين روشهائى بوده که کنگره براى نفوذ بر قوه مجريه بکار برده است.
تيزبينى کنگره از اتلاف وتقلب جلوگيرى مى کند؛ از آزادى هاى مدنى دفاع کرده، هماهنگى قوه مجريه با قانون را تضمين کرده، براى وضع قوانين و آگاهى عموم اطلاعات لازم را جمع آورى کرده، و طرز کار قوه مجريه را برآورد ميکند. اينکار شامل وزارتخانه هاى کابينه، سازمانهاى اجرائى، کميسيون هاى انتظامى و رياست جمهورى مى شود.

کارهاى نظارتى کنگره از طرق زيادى صورت مى گيرد.

• کميته هاى تحقيق و رسيدگي؛
  
• مشورت هاى رسمى با رئيس جمهور و گزارشهاى واصله از او؛
  
• توصيه و رضايت سنا براى انتصابهاى رئيس جمهور و قراردادها؛
  
• مذاکرات اعلام جرم مجلس نمايندگان و محاکمات بعدى سنا؛
  
• مذاکرات مجلس نمايندگان و سنا طبق اصلاحيه بيست و پنجم در صورتى که رئيس جمهور از کار افتاده شود، يا پست معاون رئيس جمهور خالى شود؛
  
• ملاقاتهاى غير رسمى بين مقامات قوه قضائيه و قوه مجريه؛
  
• عضويت نمايندگان کنگره در کميسيونهاى دولتي؛
  
• مطالعات توسط کميته هاى کنگره و موسسات حمايتى از قبيل دفتر بودجه کنگره، اداره حسابدارى عمومى، و دفتر برآوردهاى تکنولوژي؛

اين قوه نظارت کنگره به برکنارى مقامات رسمى از شغل خود، تغيير سياستها و فراهم نمودن اعمال کنترلهاى جديد قانونى بر شاخه اجرايى کمک کرده است. مثلا در ۱۹۴۹ تحقيقات کميته هاى فرعى تحقيق سنا فسادهايى را در بين مقامات عاليرتبه در دستگاه رهبرى ترومن نشان داد. اين کار منجر به تجديد سازمان بعضى موسسات معين و تشکيل کميسيون ويژه اى در کاخ سفيد براى رسيدگى به فساد در دولت شد.

جلسات استماع و رسيدگى کميته روابط خارجى سنا که در سالهاى آخر دهه ۱۹۶۰ از تلويزيون پخش شد به بسيج مخالفين جنگ ويتنام کمک کرد. تحقيقات کنگره در ۱۹۷۳ درباره واترگيت کار مقامات عاليرتبه کاخ سفيد را که به طور غير قانونى از موقعيت خود براى کسب امتيازات سياسى استفاده کرده بودند برملا ساخت و اعلام جرم کميته قضايى مجلس نمايندگان عليه پرزيدنت ريچارد نيکسون در سال بعد به رياست جمهورى او خاتمه داد. تحقيقات کميته هاى منتخب در ۱۹۷۶ و ۱۹۷۵ سو استفاده هاى شديد توسط سازمانهاى اطلاعاتى را شناسايى کرد و باعث وضع قوانين تازه در کنترل بعضى از فعاليتهاى اطلاعاتى شد. در سال ۱۹۸۳ تحقيقات کنگره براى پيشنهاد يکپارچه کردن عمليات بازرسى مرزى سرويس گمرکى ايالات متحده و اداره تابعيت ومهاجرت ايالات متحده سوالاتى رادر رابطه با اختيارات قوه مجريه براى انجام چنين تغييرى بدون وضع قوانين جديد برانگيخت. در ۱۹۸۷ نظارتهاى کنگره تخلفات قوه مجريه در فروش غير قانونى اسلحه به ايران و رساندن سود حاصله به نيروهاى ضد دولتى نيکاراگوآ، به نام کنتراها را آشکار ساخت. يافته هاى کنگره منجر به وضع قوانينى براى جلوگيرى از وقوع موارد مشابه شد.

تحقيقات به وسيله کميسيونهاى دوگانه کنگره و جلسات بعدى رسيدگى سنا در۶ ۱۹۹ و ۱۹۹۷ مواردى از سوء استفاده وعدم مديريت را در سرويس درآمد داخلى (IRS)، سازمان مسئول فدرال براى جمع آورى مالياتهاى درآمد آشکار ساخت. کميته مالى سنا شهادتهاى مأمورين اداره ماليات را استماع کرد که ادعا مى کردند فشار بر آنها براى بازيابى مالياتهاى پرداخت نشده آنقدر زياد بود، که گاهى ماليات دهندگان آزرده مى شدند. و نيز شهادتهاى شهروندان را که مى گفتند براى قصور در پرداخت ماليات آنها از طرف IRS به اشتباه متهم شده و با خصومت مورد تعقيب قرار مى گرفتند. در ۱۹۹۸ کنگره قانون اصلاح مالياتى را تصويب کرد که يک هيئت نظارت مستقل را بوجود آورد و حفاظت از ماليات دهندگان را گسترش داد، از جمله مسئوليت اقامه دليل در اختلافات مالياتى از دوش ماليات دهنده به اداره ماليات منتقل شد.
در موارد متعدد ثابت شده که قدرت تحقيق و تفحص کنگره وسيله اى حياتى در بازبينى و رديابى وظايف رئيس جمهور و کنترل سياستهاى عمومى بوده است.
